1. Agreement to Terms

By accessing or using MyAdvisely ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

MyAdvisely is operated by Ray-B Projects. The Service is a web-based AI-powered financial assistant designed for small and medium-sized businesses.

2. Description of Service

MyAdvisely provides an AI-powered platform that allows users to:

• Log business income and expenses via text, voice, and document upload
• Ask natural language questions about their financial data
• View financial summaries, reports, and dashboards
• Export financial data in CSV and PDF formats

MyAdvisely is a financial management tool and does not constitute professional accounting, tax, legal, or financial advice. Users should consult qualified professionals for such advice.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account

You must be at least 18 years old to use this Service. By registering, you confirm that all information you provide is accurate and current.

4. Subscription and Payment

Access to MyAdvisely requires a paid subscription. Subscriptions are billed on a recurring basis (monthly or annually) through our payment processor, Paddle.

• Subscription fees are charged in advance for each billing period
• All prices are displayed inclusive of applicable taxes where required
• Paddle acts as Merchant of Record for all transactions
• You authorise us to charge your payment method on a recurring basis
• Failure to pay may result in suspension or termination of your account

5. Refund Policy

We offer a 14-day money-back guarantee for new subscribers. If you are not satisfied with the Service within 14 days of your first payment, contact us at support@myadvisely.com for a full refund, no questions asked.

After the 14-day period:

• Subscription payments are non-refundable
• Cancellations take effect at the end of the current billing period
• You retain access to the Service until the end of the paid period
• Refunds for extenuating circumstances are considered on a case-by-case basis

To request a refund, email us at support@myadvisely.com with your account email and reason for the request.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or transmit malicious code, spam, or harmful content
• Attempt to reverse-engineer, copy, or resell the Service
• Use the Service to facilitate money laundering or financial fraud
• Share your account credentials with unauthorised third parties
• Interfere with the operation or security of the Service

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

You retain ownership of all financial data you enter into MyAdvisely. We process this data solely to provide and improve the Service.

8. Intellectual Property

The Service, including its software, design, branding, and content (excluding your data), is owned by Ray-B Projects and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not responsible for the accuracy of AI-generated financial summaries — always verify important financial decisions with a qualified professional.

10. Limitation of Liability

To the fullest extent permitted by law, Ray-B Projects shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Termination

You may cancel your account at any time through the Service or by contacting us. We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain your data for up to 90 days after termination before deletion, unless required to retain it by law.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Saint Lucia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Saint Lucia.
